Sky to appeal ITV shares ruling

BSkyB today announced that it would submit an Appeal to the Competition Commission by tomorrow, in connection with the 17.9% ITV share purchase.

Rapture TV is considering whether or not to apply as an Intervener in the BSkyB Appeal in support of the Competition Commission, as Rapture believes that BSkyB mislead the comission on the level of control BSkyB exerts on the supply of technical services to other broadcasters in the UK.

BSkyB has appointed James Flynn QC of Brick Court Chambers.  Mr Flynn was involved in the Microsoft case v the EU Commission. The EU Commission eventually won this case and Microsoft was ordered to pay over $400 million in fines.

Rapture TV’s David Henry said “It appears that BSkyB is attempting to delay the day that they are forced to sell the ITV shares.”  He went on to add “I can see little likelihood of BSkyB winning an Appeal given that BSkyB did not submit the full details of it’s operation to the Commission, and what they did submit seems to be at odds with the statements made by BSkyB’s representatives in the recent Rapture Competition Commission Appeal Tribunal hearing.   The transcripts are freely available on the Rapture website.”
